Terms of Service
These Terms of Service ("Terms") are a legal agreement between you ("User" or "you") and Patrick O'Connor / BetterPlay ("Developer," "we," "us," or "our") for use of the BetterPlay mobile application and related websites ("App").
By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App.
1. License Grant
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App for your personal, non-commercial purposes on devices you own or control, as permitted by the Apple App Store and Google Play terms.
2. License Restrictions
You agree not to:
- Copy, modify, or distribute the App
- Reverse engineer, decompile, or disassemble the App
- Rent, lease, lend, sell, or sublicense the App
- Use the App for any unlawful purpose
- Harass, abuse, or harm others
- Create fake accounts or impersonate others
- Post inappropriate, offensive, or harmful content
- Interfere with the proper functioning of the App
3. User Content
You retain ownership of content you create or upload ("User Content"). By posting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, display, and distribute it as needed to operate and provide the App.
You are responsible for your User Content and represent that you have the rights to post it and that it complies with law. We may remove content that violates these Terms.
4. Account Registration
Certain features require an account. You agree to provide accurate information, keep credentials secure, notify us of unauthorized access, and accept responsibility for activity under your account.
5. Privacy
Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
6. Intellectual Property
The App and its content, features, and branding are owned by the Developer and protected by intellectual property laws. The BetterPlay name and logo are trademarks of Patrick O'Connor.
7. Third-Party Services
The App may integrate with third-party services (maps, sign-in, hosting, analytics, etc.). We are not responsible for their content or practices. Your use of those services is at your own risk and subject to their terms.
8. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE APP.
10. Termination
We may suspend or terminate access for any reason, including Terms violations. You may delete your account at any time in Settings.
11. Changes
We may modify these Terms by posting an updated version. Continued use after changes constitutes acceptance.
12. Governing Law
These Terms are governed by the laws of the State of New York, United States, without regard to conflict-of-law principles.
13. Apple-Specific Terms
If you obtained the App from the Apple App Store, you acknowledge that these Terms are between you and the Developer, not Apple. Apple has no obligation to provide maintenance or support. Apple is not responsible for product liability, consumer protection, or IP claims relating to the App. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
